पंजाब-हरियाणा हाईकोर्ट ने पंजाब सरकार को कड़ी फटकार लगाई और कहा कि कई जिलों में न्यायिक अधिकारियों के लिए स्थायी आवास उपलब्ध न होना अजीब ही नहीं, बल्कि चौंकाने वाली स्थिति है। हाईकोर्ट यह जानकर नाराज हुआ कि मोगा, मोहाली और पठानकोट के जिला एवं सत्र न्यायाधीश अभी भी अधिग्रहित मकानों में रह रहे हैं। मुख्य न्यायाधीश शील नागू ने पूछा कि ऐसा क्यों है? इतने वर्षों से जिले मौजूद हैं, फिर भी बेसिक आवास सुनिश्चित क्यों नहीं किया गया?
सुनवाई के दौरान पंजाब सरकार ने 12 सितंबर के हाईकोर्ट आदेश में संशोधन की मांग की। उस आदेश में मालेरकोटला के डिप्टी कमिश्नर के गेस्ट हाउस और एसएसपी आवास को तुरंत खाली कराने और उन्हें जिला एवं सत्र न्यायाधीश के उपयोग में देने का आदेश दिया गया था। इसके साथ ही बिल्डिंग कमेटी को दो अस्थायी अदालत कक्षों की स्थिति पर फिर से विचार करने के लिए भी कहा गया था।
बीते दिनों सुप्रीम कोर्ट में पंजाब की ओर से तीन महीने का समय मांगा था। उन्होंने कहा कि राज्य आदेश को वापस नहीं लेना चाहता, सिर्फ उसे लागू करने के लिए और समय चाहता है। वहीं अदालत के वकील ने सुप्रीम कोर्ट में पंजाब सरकार की कार्यशैली पर सवाल उठाते हुए कहा कि राज्य ने अपनी अपील 14 नवंबर को वापस लेते समय यह तथ्य नहीं बताया कि हाईकोर्ट पहले ही 1 अक्तूबर को उसकी समीक्षा याचिका खारिज कर चुका है।
हाईकोर्ट में सुनवाई के दौरान भी अदालत के वकील ने कहा कि पंजाब उन मुद्दों को दोबारा उठाने की कोशिश कर रहा है जिन पर पहले ही अंतिम निर्णय हो चुका है। इनमें मालेरकोटला में डीसी और एसएसपी आवासों को खाली कराने से जुड़ी दलीलें भी शामिल हैं। राज्य की ओर से अदालत को बताया कि मालेरकोटला में दो नए कोर्टरूम बन चुके हैं और फैमिली कोर्ट का काम शुरू हो गया है। न्यायिक आवास के नए नक्शे 25 सितंबर को बिल्डिंग कमेटी को भेज दिए गए हैं और मंजूरी का इंतजार है। साथ ही पीडब्ल्यूडी की तकनीकी रिपोर्ट का हवाला देते हुए कहा कि डीसी गेस्ट हाउस और एसएसपी आवास अदालत कक्षों में बदलने के लिए सुरक्षित नहीं हैं।
पंजाब सरकार ने डीसी और एसएसपी आवास खाली कराने में दिक्कतें बताते हुए कहा कि वहां पुलिस कंट्रोल रूम और कार्यालय चल रहे हैं जिन्हें हटाना आसान नहीं है। इस मामले को लेकर प्रशासनिक स्तर पर काफी दबाव है और राज्य को कुछ और समय चाहिए। कोर्ट ने फिलहाल समय बढ़ाते हुए कहा कि हम आपको अभी के लिए 12 सितंबर के आदेश का पालन करने के लिए समय दे रहे हैं। अगली सुनवाई 5 दिसंबर को होगी।
